Use of the Direct Action® website constitutes agreement to our terms of use. We encourage you to review the following information carefully.
Credit Card Payments (Authorize.Net)
At Direct Action® your privacy and security are very important to us. The Direct Action® Online Store accepts payments for orders by Visa, MasterCard, Discover, and American Express. These payments are processed through Authorize.net, which is one of the most respected/secure companies to process these payments. We do not store any of your credit card information on site. Your credit card information is maintained by Authorize.net, our online payment gateway. All purchases made with a credit card will be described as charged by “Direct Action Gear” on your bank or credit card statement. Please note that we also accept debit cards. If a debit card, check card, or gift cards is used to make a purchase on the Direct Action website and the purchase is not accepted for any reason, please be aware that most banks will hold the 'authorized' funds (counting against the account balance until the authorization clears) even if the order is not accepted by Direct Action. The most common reason for a failed transaction is that the billing address entered does not match the billing address for the debit/check/credit card/gift card being used for payment.
Direct Action does not have the capability nor is obligated to release the bank's temporary hold on authorized funds. Since Direct Action does not have the capability to release the bank's temporary hold of funds, Direct Action cannot be held responsible for the policies of the customer's banking institution regarding the holding of authorized funds. Please note that authorization fund holds last for varying periods, depending on the issuing credit card company's policy. We strongly suggest that if such a situation arise, that the customer contact the issuing credit card company or bank directly.
If you have any problems with processing your payment you can contact us and select "Billing". Your inquiry will be reviewed and responded to as soon as possible.
PayPal Payments
For your convenience we do accept payments through PayPal. This is an online money transfer service which serves as electronic alternatives to traditional paper methods like checks and money orders. PayPal is one of the world's largest internet payment companies.
Other Methods of Payment
If we are not able to accept the payment on your original order, it needs to be voided, however we may still be able to accept a new order with a bank to bank wire transfer which can be arranged by first contacting a sales representative at 1-518-309-8299. If the item is voided by somebody at our sales department, they will be contacting you. We also may be able to accept a bank to bank wire transfer if you are having problems making the payment with a credit card or PayPal.
Discount Codes and Promotions
The following applies to Discount Codes and Promotions:
- Cannot be applied to previously placed orders
- Not redeemable for cash or credit
- Certain products are excluded from Discount Codes. Any product with an already discounted price is not eligible to have a discount code applied to it.
- Only one discount code can be used at a time. They are not able to be combined.
- Discount codes and Promotions are offered by Direct Action and can be ended or extended at our discretion.
Shipping
We make all attempts to honor the shipping request that you chose at check out, however please note that we have the right to upgrade your shipping service to best benefit you as a customer and us as the seller. If by chance you do not want the upgraded service you need to contact us prior to receiving shipping confirmation from us. Sales Tax
We're required by law to collect sales tax for all sales (including shipping) made by persons residing in New York and Washington State. The tax is calculated by our system according to the shipping address.
Tax Exempt Customers
For our tax exempt customers, state laws require us to have a tax exemption certificate on file at our offices. We are required to charge you sales tax if we do not have this documentation. If you are a tax exempt customer we need you to fax or email your tax exempt certificate to us prior to ordering. Once we have received your certificate we can update your account so you will not be charged sales tax. You can fax your certificate to us at 518-309-8468 or submit it using our online form.
Customs Fees and Taxes
We ship from the United States so you would be responsible for any duties, taxes and additional fees.

Indemnification
You agree to indemnify, defend and hold us and our partners, employees, subcontractors, assigns, attorneys, advertisers, product and service providers, and affiliates harmless from any liability, loss, claim and expense, including attorney’s fees, related to your violation of these Terms and conditions or use of the Direct Action® website.
Accuracy
At Direct Action® we try to keep the information on our website as accurate and up to date as possible. There may be errors that may occur and therefore result in inaccurate information being displayed. This may include, but is not limited to product description, price, images, sizing information and availability. Direct Action® is not responsible for any errors or discrepancies displayed on this website.
Warranty
Direct Action® offers a 1 year warranty on our products for any defects in materials or workmanship found in any of our products. Please go to your online profile to submit a return request. You may also contact customer service with your warranty issue. If your return is approved we will send you a return label to ship the product back to us. We will inspect product to determine if it meets warranty requirements and if it does we will replace it free of charge including shipping.
Exclusions From Coverage:
- Products purchased other than from Direct Action
- Damage from customer modification or tampering
- Damage resulting from abuse or misuse
- Product warranty excludes extended wear and tear
Returns, Refunds and Exchanges
At Direct Action® we are confident in the products we offer, but if you are dissatisfied with your purchase will gladly accept any returns or Exchanges on the condition that the item includes all of the original packaging, instructions/tags, and receipt. Items must be received within 30 days from the initial order shipping date. The returned product must be sent back unused and undamaged. We do not accept any third party returns. All returns will be inspected prior to giving a refund or exchange. The customer is responsible for any and all shipping charges for returns. You may also be responsible for up to a 20% restocking fee for any item(s) returned. The determination whether a restocking fee is applied or not is up to the discretion of Direct Action.Refunds and/or additional fees will be applied to original credit card used at the time of purchase. If return, refund, or exchange is because of a shipping error please goto our shipping policy for information. Please do not send any items back unless you have filled out a return form, which is available through your online account.
